Each service may have its own additional terms outlined in a separate proposal or contract. Clients are required to review and accept those separately.
4. Service Engagement
4.1 Proposal and Agreement
Before any service is initiated, we will provide a detailed proposal including the scope, timeline, deliverables, and cost. Once both parties agree, we proceed with the work.
4.2 Revisions
Clients are entitled to a limited number of revisions, as per the service package selected. Any extra work or out-of-scope changes may incur additional charges.
5. Payment and Refunds
5.1 Payment Terms
Payment schedules will be mentioned in the proposal. We usually follow:
- 50% advance before project initiation
- 50% after completion or milestone delivery
All payments are non-refundable once the project has commenced, except in cases where no work has been started.
5.2 Late Payments
Late payments beyond 7 days from the due date may result in service interruption and additional fees.
6. Client Responsibilities
Clients must provide necessary information, content, feedback, or access to tools/platforms (like social media or hosting) on time. Delay in providing essential inputs may result in project delays.
7. Intellectual Property
All materials, including content, designs, and code created by DigitalGun, remain our property until full payment is received. Upon full payment, the client is granted full rights to use the deliverables for commercial or business purposes.
8. Third-Party Tools and Platforms
We may use third-party platforms like Google Ads, Meta (Facebook/Instagram) Ads Manager, WordPress, Canva, etc., to execute your campaigns. We are not responsible for downtimes, policy changes, or performance issues on third-party platforms.
9. Confidentiality
We value your privacy. All client data, login credentials, and business information are kept strictly confidential and are not shared with any unauthorized third party.
10. Limitation of Liability
- DigitalGun shall not be held liable for:
- Any loss of revenue, profit, or data.
- Performance drops due to algorithm changes or platform bans.
- Issues resulting from inaccurate client information or delayed responses.
11. Termination of Service
We reserve the right to terminate any client relationship in the following situations:
- Failure to pay on time
- Abusive or unprofessional behavior
- Violations of these terms
The client also has the right to terminate service by providing written notice. However, payments already made are non-refundable.
12. Changes to Terms
DigitalGun reserves the right to update these Terms and Conditions at any time. We recommend that you review this page periodically for changes. Continued use of our services implies acceptance of the updated terms.
13. Governing Law
These Terms shall be governed in accordance with the laws of India. Any legal matters will be handled under the jurisdiction of courts in Hapur, Uttar Pradesh.
